Welcome to Virtual Me. These Terms of Service (the "Terms") form a binding agreement between you and Virtual Me ("we", "us") governing your use of virtualme.cc and related services (the "Service"). Virtual Me is operated by the legal entity identified in Section 19. By creating an account, sending a text message to our Virtual Me number, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
1. What Virtual Me is
Virtual Me is a private, AI-readable personal wiki. You add notes and sources (primarily by SMS), and you can connect third-party AI agents (e.g., Claude, ChatGPT) so they can read and write to your wiki on your behalf. AI writes land in your wiki immediately; you control every page with per-file keep, undo, and rewind from your dashboard, and you decide which pages are public. The Service is provided to you as an individual end user; business and enterprise use is not supported in this version.
2. Eligibility
You must be at least 18 years old and legally able to enter into a contract in your jurisdiction. The Service is not directed at children, and we do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us at [email protected] and we will delete it.
3. Your account
You sign up using a mobile phone number. We authenticate you with one-time 6-digit codes sent over SMS. You are responsible for keeping access to that phone number, for everything that happens under your account, and for promptly notifying us at [email protected] if you suspect unauthorized access. We may suspend or close accounts that we reasonably believe are compromised, fraudulent, or in breach of these Terms.
4. SMS messaging terms
The Service is SMS-centric. By providing your mobile number and texting "hey virtualme" (or any message) to our Virtual Me number, you agree to receive SMS messages from us, including:
- one-time login codes;
- transactional account messages (e.g., billing receipts, security alerts);
- AI-agent change-approval prompts and similar product notifications you have asked us to send.
Message frequency: variable, based on how you use the Service. Typical users receive between a few and several dozen messages per week.
Message and data rates may apply. Your mobile carrier's standard message and data rates apply to any messages you send or receive. We do not charge for SMS, but your carrier may.
HELP: reply HELP to any of our
messages to receive support contact information.
STOP: reply STOP,
CANCEL, END, QUIT,
or UNSUBSCRIBE to opt out of further non-essential
SMS. We will send one confirmation message. You can rejoin by texting
"hey virtualme" again.
Consent is not a condition of any purchase. If you opt out of SMS, you may lose access to SMS-based features (including login), since SMS is currently our only authentication channel.
Outbound SMS is sent from a Twilio long code registered to Virtual Me. Carriers may occasionally fail to deliver messages; we are not responsible for carrier behavior.
5. Subscriptions, billing, and refunds
Plans. The Service has a free tier (up to 200 pages; unlimited AI connectors) and a paid tier ("Virtual Me Pro") at USD $8 per month, charged in advance, recurring monthly until cancelled. Tier differences today are the page cap and a per-account disk-space ceiling (free: 10 MB, pro: 200 MB); everything else (connectors, mindmap, history, export) is identical. Specific limits may change; the current values are surfaced in your dashboard and any paywall message the Service shows you. We may add additional plans in the future; pricing for new plans will be shown before you subscribe.
Auto-renewal. Paid subscriptions renew automatically each month on the same calendar day, charged to the payment method on file, until you cancel. By subscribing, you authorize us (through Stripe) to charge that payment method on a recurring basis.
Payment processor. All payments are handled by Stripe. We do not store full card numbers on our servers. Your use of Stripe-hosted checkout is also subject to Stripe's terms.
Currency and taxes. Prices are in US dollars unless otherwise stated. You are responsible for any sales tax, VAT, GST, HST, or similar taxes that apply in your jurisdiction. We may collect such taxes where we are required to.
How to cancel. Pro users can cancel any time from the "manage subscription" link on /me, which opens the Stripe customer portal. You can also email [email protected] from the address associated with your account, or from any address with proof of account ownership, and we will cancel within 2 business days.
Refunds.
- 7-day no-questions refund. If you request a refund within 7 days of a charge, we will refund it in full, no questions asked.
- Pro-rated refund within 14 days. Between days 8 and 14, we will refund the unused portion of the most recent billing cycle on request.
- After 14 days. No refunds, except where required by applicable consumer-protection law (including non-waivable rights under EU and Canadian law).
Failed payments. If we cannot charge your payment method, we may downgrade you to the free tier and retain your data. Repeated failures over 30 days may result in feature restriction or account closure.
6. Acceptable use
You agree not to use the Service to:
- store, transmit, or generate content that is illegal in your jurisdiction or ours;
- store or distribute child sexual abuse material (CSAM) — this will result in immediate termination and, where required, a report to NCMEC or equivalent authorities;
- send spam, conduct harassment, or run unsolicited mass outreach;
- abuse the AI write surface to impersonate, defame, dox, or harass other people;
- scrape the Service at scale, run automated load that we have not authorized, or attempt to overwhelm our infrastructure;
- reverse-engineer, decompile, or attempt to extract source code, model weights, or trade secrets, except to the limited extent that applicable law makes such restrictions unenforceable;
- circumvent rate limits, plan limits, or security controls; or
- resell the Service or use it to operate a competing service.
We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated this section. Where we can do so without prejudicing an investigation, we will tell you why and give you a chance to respond.
7. Your content
You retain ownership of everything you put into your Virtual Me — your notes, files, prompts, and the wiki we build around them ("Your Content"). You grant us a limited, worldwide, royalty-free license to host, transmit, encrypt, back up, and display Your Content solely to operate the Service for you.
We do not use Your Content to train any AI model — ours or anyone else's. See the Privacy Policy, Section 7, for the precise commitment.
You represent that you have the rights necessary to upload Your Content and that doing so does not violate anyone else's rights or applicable law.
8. Third-party AI agents
Virtual Me lets you connect external AI agents (Claude, ChatGPT, and others). When you connect such an agent, you are sending Your Content to a third-party service governed by that third party's terms and privacy policy, including any policies they have about model training. We have no control over those third parties. We recommend reviewing their terms before connecting them. Every write proposed by a connected agent lands in your wiki immediately; you can keep, undo, or rewind each edit, and you decide which pages are public.
9. Data export and deletion
You can export your entire wiki as a .tar.gz archive at
any time via /api/export. If you ask us to delete your
account, we will do so within 30 days, subject to
the limited retention exceptions described in the
Privacy Policy (e.g., billing records we are
required to keep).
10. Service availability
The Service is provided on a best-effort basis. We do not offer a service level agreement (SLA) for this version. We may perform planned maintenance, occasionally with little notice. We will try to schedule disruptive maintenance during low-traffic windows and announce it via SMS, email, or an in-product banner when we can.
We are not liable for downtime or data inaccessibility caused by events beyond our reasonable control, including infrastructure provider outages (Hetzner, Cloudflare, Stripe, Twilio, our storage provider Mesa), carrier outages, internet routing failures, attacks, natural disasters, war, civil unrest, government action, or pandemic-related disruption (collectively, force majeure).
11. Security
We describe our security practices in the Privacy Policy, Section 8. Briefly: per-user encryption-at-rest with keys held under a master key, TLS in transit, hardened VPS, no third-party analytics. We have not completed a SOC 2 audit. No system is perfectly secure, and we do not promise that ours is.
12. Warranty disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI outputs will be accurate, complete, or fit for any decision you make based on them. Nothing in this section limits any non-waivable warranty you have under applicable consumer-protection law.
13. Limitation of liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to the Service, even if we have been advised of the possibility.
- Our total aggregate liability to you for all claims arising out of or relating to the Service in any twelve-month period is capped at the greater of (a) USD $100 or (b) the total amount you paid us in the twelve months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow exclusions or limitations of certain damages; in those jurisdictions, our liability is limited to the smallest extent permitted by law.
14. Indemnification
You will defend, indemnify, and hold harmless Virtual Me (and the legal entity operating it, identified in Section 19), its officers, directors, and contractors from any third-party claim, loss, or expense (including reasonable legal fees) arising out of (a) Your Content, (b) your breach of these Terms, or (c) your violation of any law or third-party right through your use of the Service. We will give you prompt notice of any such claim and reasonable cooperation in defending it.
15. Termination
You can stop using the Service at any time by emailing [email protected] and asking us to close your account.
We can suspend or terminate your account if you materially breach these Terms, if we are required to by law, or if continuing to provide the Service becomes commercially impracticable. Where we end the Service entirely, we will give reasonable advance notice and a chance to export your data.
Sections that by their nature should survive termination — including Sections 7 (last paragraph), 12, 13, 14, 16, 17, and 18 — survive.
16. Changes to these terms
We may change these Terms from time to time. For material changes, we will give you at least 30 days' notice before they take effect, via the email address on your account or an in-product banner. Continuing to use the Service after the effective date of a change means you accept it. Non-material changes (typo fixes, clarifications, contact updates) take effect when posted.
17. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario, Canada and the federal laws of Canada applicable there, without regard to conflict-of-laws principles. You and we submit to the exclusive jurisdiction of the courts located in Toronto, Ontario, for any dispute that is not subject to mandatory arbitration or small-claims jurisdiction in your home forum.
If you are a consumer resident in the EU, UK, or another jurisdiction whose law gives you a non-waivable right to sue in your home courts under your home law, nothing in this section takes that right away.
18. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between us about the Service.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Severability. If a provision is unenforceable, the rest stays in force.
- Assignment. You may not assign these Terms. We may assign them to an affiliate or to a successor in a merger, acquisition, or sale of assets.
- Notices. We will reach you at the email/phone number on your account. You can reach us at [email protected].
